His visionary words seem to have taken on renewed relevance. The Europe referred to here is that understood as a cultural reality, as the civilization that has given rise to a way of life known as "Western" and which has transcended the other continents to varying degrees. The present work is a modest attempt to contribute to fulfill the fortunate suggestion of Benedict XVI through a synthetic review of the four most decisive factors of cohesion in the original shaping of Europe's identity: Greek philosophy, Roman law, Christianity and the Germanic factor. The purpose of this journey is to review the identity that Europe seems to want to forget, but whose knowledge may be vital for its survival.
2023-12-19T00:00:00+01:00Copyright (c) 2023 Gabriela Cobo Del Rosal Pérezhttps://vergentis.ucam.edu/index.php/vergentis/article/view/273Labeo, Paulus and Ulpian: Causal reasoning and contract liability2023-11-01T23:37:12+01:00Patricio Lazo
Abstract: The aim of this paper is to examine to what extent jurists such as Labeo, Paulus or Ulpianus used causal analysis in the elaboration of answers to problems of contractual liability, specifically those related to the lease contract. To achieve this objective, the paper offers, firstly, an overview of Hellenistic philosophy on causation, in order to contextualize the coordinates of the doctrines on causation that may have influenced the thinking of Roman jurists. Next, it presents three problems solved by jurists, all, as already mentioned, relating to leasing, to explore the use of causal reasoning in them and the differences that would have occurred in this context. The result of the inquiry is the finding of differences between the thinking of Labeo and Paulus, as well as Ulpian's adherence to the former's type of analysis.
2023-12-19T00:00:00+01:00Copyright (c) 2023 Patricio Lazohttps://vergentis.ucam.edu/index.php/vergentis/article/view/267Approach of Law in hudita’s Murcia2023-05-23T22:49:50+02:00Julián Gómez de Maya
In the city of Murcia in the 13th century, a diversity of political situations and legal systems converged: the independent Muslim capital, the protectorate of Castile, full incorporation into this Crown. The present work tends, therefore, a legal overview of the century, with the successive hegemony and validity of the Islamic and Castilian legal systems, plus the minority and parallel use and force of the Jewish, Mozarabic and Mudejar statutes in the respective colonies. In addition, when attending to their interrelationships, a particularized notion of each of these systems is not disregarded either.
2023-12-19T00:00:00+01:00Copyright (c) 2023 Julián Gómez de Mayahttps://vergentis.ucam.edu/index.php/vergentis/article/view/270Coeducation, plurality and public space: an analysis regarding the LOSU2023-06-18T18:15:02+02:00María José Ibáñez Ayuso
In Spain, single-sex education generates numerous controversies, which have been accentuated with the LOMLOE and its obligation to practice coeducation in schools supported totally or partially with public funds. Although with less media coverage, this debate is also observed in the seventh additional provision of the LOSU regulating the Colegios Mayores, where an amendment was included that establishes that colleges that segregate students by sex will not be able to be attached to a public university. The aim of this research is to analyze from a legal and educational perspective the arguments that support this amendment, as well as its legislative coloraries. For this purpose, both a critical hermeneutic analysis of different legal sources and a pedagogical analysis of issues related to the affective-sexual education of young people are carried out. The analysis allows us to question the simple assumption of coeducation in Colegios Mayores being the most effective measure for the improvement of coexistence between both sexes and allows us to affirm that the inclusion of this amendment in the legislation supposes a serious prejudice to the freedom of creation of centers, to the freedom of choice of students and to university autonomy.
2023-12-19T00:00:00+01:00Copyright (c) 2023 María José Ibáñez Ayusohttps://vergentis.ucam.edu/index.php/vergentis/article/view/120Crisis, migration and responsible parenthood: contemporary issues2020-10-29T07:26:08+01:00Reinaldo Batista Cordova
2023-12-19T00:00:00+01:00Copyright (c) 2023 Reinaldo Batista Cordova
