In particular, it will be analyzed how the so-called <em>Canon Redintegranda</em> of the <em>Decretum</em> <em>Gratiani</em>, as well as the Decretals of Gregory IX, in particular, title XIII of book II whose rubric reads <em>De restitutione expoliaturum</em>, are integrated into the texts of the <em>Furs de València</em> for the summary protection of possession.</p> <p>&nbsp;</p> <p><strong>Keywords</strong>: possession; possessory defense; <em>exceptio spolii</em>; <em>actio spolii</em>; <em>Furs de València</em>.</p> 2022-03-30T00:00:00+02:00 Copyright (c) 2021 Revista de Investigación de la Cátedra Internacional conjunta Inocencio III https://vergentis.ucam.edu/index.php/vergentis/article/view/230 La techne Aristotelica: for a philosophical research on the theme "The human roots of the Ecological Crisis" in the encyclical Laudato Si' 2022-02-04T12:07:42+01:00 Giulia Lombardi vergentis@ucam.edu <p>In the encyclical <em>Laudato si’ </em>the strong call to recognize "<em>the human root of the ecological crisis</em>", namely the cause of the "<em>awry</em><em> way of understanding human life and action</em>", focuses on "<em>the dominant technocratic paradigm</em>". With this paper I intend to point out the undue transformation of technology into domination and one-dimensionality, proposing to go to the Greek roots, from whose language the words 'technology' and 'technocracy' come. The senses by which the word ‘<em>techne</em>’ was ordinarily used, are indeed articulated starting from the awareness of the community dimension of life, in which man can overcome his own weaknesses and lacks, developing the potentialities of each one for the common good and the plurality of the ways of actualization, on condition of acquiring knowledge by learning-teaching. In the proposal to recover the Greek notion of <em>techne</em>, highlighting its plural, collective and didactic character, I also qualify it as 'Aristotelian', to emphasize two provisions, given by the teachers of the first philosophical schools, Plato and then Aristotle: knowledge is said to be acquired by <em>techne</em> provided that from those who are able 1) to give explanations and 2) to indicate the ultimate goal, where the concepts of <em>true</em>, <em>good</em> and <em>beautiful</em> converge in the dimension of <em>sophia</em>.</p> <p>&nbsp;</p> <p><strong>Keywords</strong>: <em>Laudato si’</em>;<em> techne</em>; Aristotle; <em>Metaphysics</em>; theoretical sciences; common good.</p> 2022-03-30T00:00:00+02:00 Copyright (c) 2021 Revista de Investigación de la Cátedra Internacional conjunta Inocencio III https://vergentis.ucam.edu/index.php/vergentis/article/view/231 The sacred nature of the landscape between "Integral Ecology" and the Law Of Sustainability 2022-02-03T13:16:03+01:00 Paolo Passaniti vergentis@ucam.edu <p>The essay offers a reflection on the relationship between landscape and faith, starting from the cultural landscape that the author associates with his personal idea of landscape: the reference to the distant view of the convent founded by San Paolo della Croce on Monte Argentario. The landscape understood as an harmonious insertion into nature and a vision that is affected by the mark left by that settlement, taking on meanings that go beyond the visible. The concept of religious landscape is faced from the emotional point of view in which the sacredness of places completes and enhances nature. In short, there are common grounds between laity and Catholics around the great theme of the cultural landscape as a common good, an expression of human settlement in its historical stratifications. The Municipality of Viterbo, by virtue of an ancient custom, transposed into the local statutory law and confirmed with papal approval, was <em>domina juris pascendi</em> and, in this role, could demand that it be paid the tax for the exploitation of the pasture (<em>fida</em> or <em>affida</em>). Among them, the right to appoint knights by heads of deposed royal families has been one of the focal points. The author begins with a comprehensive review of legal debates on the subject to provide readers with an up-to-date understanding on this developing topic. Six major views on the appointment are extracted from the review. Then, a new interpretation is proposed, wherein the legitimacy to confer honours and the legitimacy of the orders of knighthood themselves have to be considered separately. A society that abandons the old feudal system and gives way to a new society where money is increasingly imposed both in politics and in social relations. Francisco lives a new social era where relationships cease to be one of subordination and dependence. But the Church remains feudal and this caused discomfort to the humble people. Francisco, due to the life he chose, rejected everything that prevented living evangelical poverty. Francisco tries to regulate the life of the brothers through the Rules.
